These Terms of Service ("Terms") govern your use of the Fits In The Box application ("App", "Service") provided by Fits In The Box ("we", "us", or "our"). By installing or using our App, you agree to these Terms.
1. Description of Service
Fits In The Box is a Shopify application that helps merchants optimize shipping costs through 3D bin packing calculations. The App calculates optimal box sizes, provides shipping estimates, and suggests products that fit in available box space.
2. Eligibility
You must have an active Shopify store to use our App. By using the App, you represent that you have the authority to bind your business to these Terms.
3. Account and Access
Access to our App is provided through your Shopify account. You are responsible for maintaining the security of your Shopify credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the App's functionality
- Reverse engineer, decompile, or disassemble the App
- Use the App to transmit malicious code
- Resell or redistribute the App without authorization
5. Pricing and Payment
Our App may offer free and paid plans. All charges are billed through Shopify's billing system. Prices are subject to change with reasonable notice. You may cancel your subscription at any time through the Shopify admin.
6. Data and Privacy
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to our data practices as described in the Privacy Policy.
7. Intellectual Property
The App, including its code, design, features, and documentation, is owned by us and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for your business purposes.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SHIPPING ESTIMATES PROVIDED BY THE APP ARE APPROXIMATIONS AND ACTUAL SHIPPING COSTS MAY VARY.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Modifications to Service
We reserve the right to modify, suspend, or discontinue the App at any time with or without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.
12. Termination
We may terminate or suspend your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may terminate your use by uninstalling the App from your Shopify store.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.
